Agreement to Terms

By accessing our website, requesting a consultation, or using the services of Project 2 Studios ("we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Services Provided

Project 2 Studios provides social media marketing services including:

  • Professional video content creation (30+ videos per package)
  • Social media training and education
  • Content strategy development
  • Social media management (optional)
  • Paid advertising campaign management (optional)

Specific services, deliverables, and pricing are outlined in individual service agreements provided during your consultation.

No Guarantee of Results

IMPORTANT: We do NOT guarantee specific business outcomes, revenue increases, customer acquisition numbers, follower growth, or engagement rates. Your actual results will vary based on multiple factors including:

  • Your Industry & Market: Competition level, market saturation, seasonal factors, and industry trends
  • Your Business Quality: Product/service quality, pricing, customer service, and business reputation
  • Your Effort Level: Implementation of our recommendations, consistency, responsiveness, and active participation
  • Your Ad Budget: Amount invested in paid advertising beyond our service fees
  • External Factors: Algorithm changes, platform policy updates, economic conditions, and market shifts

Success stories and testimonials represent individual client experiences and should not be interpreted as typical results or guarantees of future performance.

Payment Terms

  • Video Content Packages: One-time payment due before project commencement
  • Management Services (if applicable): Billed monthly in advance
  • Advertising Spend: Separate from service fees, paid directly to ad platforms
  • Late Payments: May result in service suspension and late fees
  • Refund Policy: Services are generally non-refundable once work has commenced. Specific refund terms outlined in service agreement

Client Responsibilities

To achieve optimal results, clients agree to:

  • Timely Communication: Respond to requests within reasonable timeframes (typically 48-72 hours)
  • Accurate Information: Provide complete and accurate business information, goals, and target audience details
  • Access & Cooperation: Grant necessary access to social media accounts, provide required materials, and participate in scheduled calls/meetings
  • Implementation: Apply training and recommendations to your marketing efforts
  • Advertising Investment: Allocate appropriate budget for paid advertising if pursuing ad-based growth strategies
  • Legal Compliance: Ensure all content, claims, and business practices comply with applicable laws and platform policies

Failure to fulfill these responsibilities may impact results and does not entitle clients to refunds or fee adjustments.

Contract Duration & Termination

Video Content Services:

  • One-time service with defined deliverables
  • Completion typically within 7-14 days
  • No ongoing commitment after delivery

Ongoing Management Services (if applicable):

  • Month-to-month basis unless otherwise specified
  • Either party may terminate with 30 days written notice
  • Partial month cancellations are not prorated
  • Access to created content retained after termination

Intellectual Property Rights

Content Ownership:

  • Video content created for your business becomes your property upon full payment
  • You retain full rights to use, modify, and publish the content
  • We retain the right to showcase work in our portfolio and marketing materials (unless otherwise agreed)
  • Pre-existing intellectual property (logos, trademarks, etc.) remain your property

Limitation of Liability

To the maximum extent permitted by law:

  • No Indirect Damages: We shall not be liable for indirect, incidental, special, consequential, or punitive damages including lost profits, lost revenue, or lost business opportunities
  • Maximum Liability: Our total liability shall not exceed the amount paid for services in the preceding three months
  • Platform Changes: We are not responsible for changes in social media platform algorithms, policies, or features that impact results
  • Third-Party Actions: We are not liable for actions of third-party platforms, advertisers, competitors, or users
  • Client Actions: We are not responsible for results stemming from client decisions, implementations, or business operations

Warranties Disclaimer

Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Uninterrupted or error-free service
  • Specific results or outcomes
  • Accuracy or reliability of information

Indemnification

You agree to indemnify and hold harmless Project 2 Studios, its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Content you provide for use in campaigns

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of New Hampshire.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
